Terms of Service

These Terms of Service ("Terms") describe the agreement between you and Creatorz+ Inc (also "Creatorz+", "we", "us") for use of our website, services, and any related consultations or deliverables. They explain what you can expect when working with us, important responsibilities on both sides, and how we handle topics like pricing, intellectual property, and liability.

Overview

These Terms govern your access to and use of creatorzplus.biz and any services we provide, including website builds, AI/chatbot setup, mobile apps, branding work, consultations, and ongoing support. When we provide services to you under a separate written agreement (for example, a proposal or scope of work), those terms combine with and may modify these Terms — the written agreement will control where there is a conflict.

The effective date of these Terms is the date you first accept them, use our website, or sign a separate agreement. We may update these Terms from time to time; material changes will be posted on the site and, where appropriate, communicated directly to clients.

Website Use

You may use our website and materials for lawful purposes only. You agree not to access or attempt to access areas of our site that are restricted, to interfere with site operation, or to use the site in a way that harms other users or the service. If you create an account, you are responsible for maintaining the security of your credentials and for any activity that occurs under your account.

Prohibited conduct includes, but is not limited to: unauthorized access, scraping data without permission, uploading harmful content (malware, viruses), or using the site for unlawful advertising or spam. If we provide account features or dashboards as part of a service, you are responsible for the accuracy of any information you provide.

Services & Deliverables

Creatorz+ delivers digital services across several categories. Typical offerings include website and landing page builds, AI chatbot configuration, mobile application development, branding and design, social media content support, and IT support for small businesses. Deliverables are defined in each project proposal and may include design files, production websites, source assets, integrations, or documentation.

Deliverables are provided in common, editable formats where applicable (for example: HTML/CSS/JS, WordPress or chosen CMS exports, PNG/SVG/AI design files, JSON or CSV exports for data, and specification/hand-off documents). We list expected file types and hand-off notes in each proposal so there are no surprises.

Timelines & Formats

Project timelines depend on the agreed scope, client responsiveness, and third-party factors. Proposals include estimated delivery schedules; these are target dates and not guarantees. For many website projects, initial staging previews are delivered within 2–6 weeks depending on scope. Smaller items and support requests are typically handled within business-day SLAs defined in the project agreement.

When integrations are involved (payment gateways, third-party APIs, app stores), delivery times can be affected by external approvals or review processes. We will communicate expected formats and hand-off instructions with each milestone.

Consultations and Advice

We offer consultations to help you plan projects, prepare proposals, and make informed decisions about technology and marketing. Consultations may be included with certain engagements or offered as standalone sessions. Advice given during consultations is intended to be practical and experience-based, but it is not a substitute for professional legal, financial, medical, or regulatory advice.

When you request a consultation, we will propose a scope and fee (if applicable). Recommendations are based on the information available at the time of the consultation; outcomes depend on implementation, ongoing actions, and factors outside our control.

Quotes & Pricing

We prepare quotes based on the details you provide and our assessment of the required work. Quotes reflect the scope described in the proposal and will include payment terms, milestone schedules, and any assumptions. Unless otherwise stated, quotes expire after the period noted in the proposal (commonly 30 days).

A quote is an estimate of expected costs. Final invoices reflect actual work performed, agreed change orders, and any third-party costs incurred. We will notify you promptly if we anticipate that the final cost will exceed the quoted amount.

Examples of factors that can change pricing mid-project include:

  • Change requests that expand the original scope (new pages, features, or integrations).
  • Significant delays or rework caused by late client feedback or incomplete materials.
  • Third-party fees or licensing costs not included in the original quote.

Project Scope & Changes

Each project begins with a defined scope of work documented in a proposal or statement of work. The scope describes deliverables, timelines, milestones, and responsibilities. Work performed outside the agreed scope is considered out-of-scope and will be handled through a change request process.

To request a change, clients submit a change request that describes the desired modifications. We will assess the request and provide a written estimate for any additional time and costs. Work on changes typically begins after you approve the change request in writing.

Example: If a website build is scoped for 5 pages and the client requests an additional 3 pages mid-project, we will provide a quote for the extra pages and update the schedule. The additional pages are out-of-scope until the change order is signed.

Client Responsibilities

Successful projects rely on timely client input and access. You agree to provide required content, assets, access to systems (hosting, domain, third-party accounts), branding materials, and timely approvals. Please ensure materials you supply do not infringe third-party rights and are accurate. If we need credentials to integrate services, provide them securely and in a timely fashion.

Response-time expectation: We ask for responses to revision requests, approvals, or clarifying questions within the timeframes stated in the proposal (commonly 3–5 business days). Delays can impact project timelines and may incur additional fees. If you anticipate a delay, please inform us as soon as possible so we can adjust schedules.

Third-Party Platforms & Integrations

Many projects involve third-party platforms (hosting providers, payment processors, app stores, APIs, plug-ins, themes). When we integrate or configure third-party services, you are bound by the third party’s terms and licensing. You are responsible for any fees, accounts, and compliance required by these services.

Creatorz+ will make reasonable efforts to select reliable partners and follow best practices for integration. However, we are not liable for outages, policy changes, security issues, or other failures caused by third parties. If a third-party platform changes pricing, terms, or access and that materially affects a project, we will notify you and propose a solution.

AI, Chatbots & Mobile App Limitations

AI tools, chatbots, and model-driven features are increasingly useful but come with limits. Where we build or configure AI-driven features, we will document data sources, behavior expectations, and known limitations. AI outputs are probabilistic and may produce incorrect or biased responses; you should not rely on AI outputs as definitive legal, medical, financial, or regulatory advice.

If our work processes or features involve user data, we will describe handling and retention in project documents and our Privacy Policy. You are responsible for ensuring that any use of AI or automated decision-making complies with applicable laws and regulatory requirements for your industry.

We do not guarantee specific performance from AI components (accuracy, uptime, or outcomes) and are not liable for decisions made solely on AI-generated output.

Payments & Billing

Payment terms are set in each proposal. Many projects require a deposit or initial invoice prior to starting work, with remaining fees invoiced by milestone or on completion. For ongoing services, we issue regular invoices per the agreement. Unless otherwise agreed, payments are due within the payment window specified on the invoice.

We accept the payment methods listed in your invoice (commonly bank transfer, card payment, or online payment links). Late payments may be subject to interest or late fees as specified in the proposal. If a payment is significantly overdue, we may suspend services until payments are current.

Refunds and retainers are handled per the written agreement. For questions about billing, please contact our billing team so we can address concerns quickly.

Revisions, Approvals & Results

Project proposals include revision terms (for example: number of revision rounds per milestone). We request consolidated feedback to keep projects efficient. Major rework beyond the agreed revision limits may be billed as additional work. Approval gates (design approvals, content sign-off, final acceptance) will be documented and trigger the next phase of work or final invoice.

While we use proven practices to improve outcomes (SEO basics, conversion-focused design, reliable development), we cannot guarantee specific results such as search rankings, revenue, or conversion rates. Results depend on many factors outside our control, including market conditions, ongoing marketing, platform algorithms, and user behavior.

Intellectual Property & User Submissions

Ownership of deliverables and rights granted to you will be defined in each proposal. Typically, upon full payment for custom work, we grant clients the agreed license or ownership to final deliverables so they can use them for their business. We retain ownership of our pre-existing tools, templates, frameworks, and code not specifically assigned in writing.

By providing materials (logos, content, images, data), you represent that you have the necessary rights and licenses for us to use those materials and to include them in the work. You grant Creatorz+ a non-exclusive, royalty-free license to use client-provided materials solely for performing the services and for portfolio or promotional purposes unless you request otherwise in writing.

For collaborative or iterative work-in-progress, we may retain copies of drafts and intermediate files for record-keeping and support. If you need exclusive ownership or transfer of underlying source code, please make that request in the proposal so we can include necessary terms and fees.

Limitation of Liability

To the maximum extent permitted by law, Creatorz+’s liability for claims arising from our services or this agreement is limited to the total amount you paid for the specific services that gave rise to the claim. We are not liable for indirect, incidental, consequential, special, or exemplary damages (including lost profits or data loss), even if we have been advised of the possibility of such damages.

You agree to indemnify and hold us harmless from third-party claims arising from your content, misuse of deliverables, or failure to obtain necessary rights. Where applicable and practical, we maintain business insurance; clients are encouraged to carry their own insurance appropriate to their operations.

Policy Changes & Contact

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page with a new effective date. For existing clients with a signed agreement, changes to these public Terms do not automatically change negotiated contract terms unless both parties agree in writing.
